PRIVACY POLICY

Welcome to the Kedaireka Platform.

The Kedaireka Kampus Merdeka Platform (hereinafter referred to as “Kedaireka”) is a platform provided, managed, and developed by the Directorate General of Higher Education, Research, and Technology and the Directorate General of Vocational Education of the Ministry of Education, Culture, Research, and Technology of the Republic of Indonesia (hereinafter referred to as the “Ministry”). Kedaireka is an acronym for *Cooperation between Business and Kreasi Reka*. It can also be interpreted as Indonesian Sovereignty in Creative Innovation. The Ministry aims to build a platform that facilitates cooperation between universities and the Business and Industrial Sectors, as well as other related parties. The Kedaireka Kampus Merdeka Platform is expected to become a hub for meetings and communication between creators in universities (hereinafter referred to as “Insan Dikti”) and the Business and Industrial Sectors.

Insan Dikti and the Business and Industrial Sectors can establish cooperative relationships where Industry provides Peluang Cipta or business cases to be solved by Insan Dikti, and Insan Dikti can offer Creative Innovations as inventions that can be utilized by the industry. For this purpose, the Ministry will provide services related to cooperation or facilitate supply and demand between Insan Dikti and the Business and Industrial Sectors and other related parties for Users.

This Privacy Policy (hereinafter referred to as the “Privacy Policy”) sets out the basic principles on how the Ministry uses personal information received from Users (hereinafter referred to as “Personal Information”).

The confidentiality of Personal Information is important to the Ministry, and the Ministry is responsible for protecting and respecting Users' Personal Information (hereinafter referred to as “Users”) in accordance with applicable laws.

The Ministry is committed to managing, protecting, analyzing, and processing Users' Personal Information in accordance with the Privacy Policy applicable to all Personal Information obtained by the Ministry from Users through the Kedaireka platform, whether at the time of registration, access, or use of the services and features provided on Kedaireka.

This Privacy Policy applies to all Users of the Kedaireka platform. If Users do not agree with any part, portion, or all of this Privacy Policy, they are not permitted to continue accessing and are advised to leave the Kedaireka Platform.

By accessing and/or using Kedaireka, Users declare that all information used is true and valid. By registering, accessing, and/or using Kedaireka, Users consent to the Ministry obtaining, collecting, storing, managing, and using the information in accordance with the provisions of the Kedaireka Privacy Policy as follows:

  1. PURPOSE OF THE PRIVACY POLICY

This Privacy Policy explains how the Ministry will process and secure Users' personal information and the rights and choices that Users have in relation to the management of Personal Information.

This Privacy Policy applies to Personal Information provided by Users to the Ministry when Users use the Kedaireka platform or additional services available on the Kedaireka platform.

  1. INFORMATION COLLECTION

Kedaireka collects Users' information to manage and facilitate the use of the Kedaireka platform and for other purposes.

The Ministry ensures that all obligations to guarantee privacy protection under applicable laws have been met and can be fulfilled.

The Ministry collects information about Users when they visit the Kedaireka Platform and use the services and features provided by the Ministry on the Kedaireka Platform. The types of documents managed by the Ministry from time to time may include personal information such as:

  1. Full name;
  2. Email address;
  3. National identification number;
  4. Phone number;
  5. National lecturer identification number; and
  6. Other identifiable personal information provided by Users to the Ministry in any form or obtained by the Ministry through any interaction between the Ministry and Users in connection with the use of the Kedaireka platform.

  1. USE OF INFORMATION

Kedaireka may use all or part of the information obtained and collected from Users for purposes such as:

  1. Providing Kedaireka platform services to Users;
  2. Managing User Accounts to verify identity;
  3. Processing all forms of requests and activities carried out by Users through Kedaireka;
  4. Monitoring, detecting, and preventing unauthorized or improper use of Kedaireka platform services;
  5. Providing features to deliver, implement, maintain, and improve Kedaireka platform services, including:
  1. Conducting internal activities necessary to provide services on Kedaireka, such as troubleshooting software, operational issues, data/information analysis, testing, and research, and monitoring and analyzing usage trends and activities;
  2. Assisting Users when communicating through the services provided by the Ministry on Kedaireka, including:
  1. Checking and resolving User issues;
  2. Directing User inquiries to the appropriate Kedaireka officers to resolve issues; and
  3. Monitoring and improving Kedaireka Service responses.
  1. Contacting Users via email, phone, fax, etc., including but not limited to assisting and/or resolving issues;
  2. Communicating with Users regarding inquiries, requests, and feedback from Users regarding material changes to the Terms and Conditions within Kedaireka or other terms and conditions related to the management of User Accounts;
  3. Providing opportunities for Users to voluntarily participate in surveys related to the website or services provided by the Ministry to Kedaireka;
  4. Informing Users about services, news, updates, etc., whether through Kedaireka or other media;
  5. During general browsing, the server will record relevant actions, including the IP address of the connected device, time of use, browser used, browsing and clicking data records, and others as a reference for the Ministry's website services. Note that this process is internal, and the information obtained by the Ministry will not be released or published;
  6. In certain circumstances, the Ministry may use or disclose User information for law enforcement purposes or to fulfill legal and regulatory requirements.

Users are required to provide clear registration information and content to be collected by the Ministry on the Kedaireka Platform. At its discretion, the Ministry reserves the right not to allow Users to use Kedaireka platform services if the Ministry finds discrepancies in the information data provided by Users.

In addition to the data mentioned above, the Ministry reserves the right to request and collect other data and information from Users. Users, therefore, cooperate with the Ministry by providing the data and information requested by the Ministry to ensure the smooth provision of Kedaireka Platform services to Users.

If Users provide Personal Information belonging to third parties by submitting that Personal Information to the Ministry, Users represent to the Ministry that they have obtained the consent of those third parties to provide Personal Information for such purposes.

  1. DISCLOSURE OF USERS' PERSONAL INFORMATION

The Ministry guarantees that it will not provide, exchange, sell, lend, or rent Users' Personal Information to individuals, groups, companies, or other public authorities, or what may be referred to as third parties, without the User's permission, except in the following cases:

  1. With written consent from Users;
  2. When disclosure of User Information by the Ministry and third parties assisting the Ministry in delivering services on the Kedaireka Platform and processing all forms of User activities on the Kedaireka Platform is required;
  3. When communication is required between the Ministry's consultants and Users in resolving issues or other matters;
  4. To fulfill legal obligations and/or in response to legitimate requests from law enforcement authorities; and
  5. Other parties authorized by Users to receive disclosure of their Personal Information from the Ministry.

Kedaireka is not responsible for issues arising from the exchange of data and information directly outside the Kedaireka platform between Kedaireka users and partners that occurs without Kedaireka's involvement.

  1. ACCESSING OR CORRECTING PERSONAL INFORMATION

Users can access or correct their username, email address, date of birth, mailing address, and phone number by:

  1. Logging into their User Account;
  2. Selecting “Account Information“ and clicking the “Edit“ option in the column to be corrected on Kedaireka.

The Ministry will send the corrected Personal Information to any person or legal entity that has received disclosure from the Ministry, except when such person or legal entity does not require the corrected Personal Information for any legal or commercial purpose, or when the User and the Ministry agree that the corrected Personal Information does not need to be disclosed to the relevant person or legal entity.

  1. WITHDRAWAL OF CONSENT

Users may withdraw their consent for the collection, use, and/or disclosure of their Personal Information that the Ministry holds or controls. Please note that:

  1. Users will no longer be able to access their User Account;
  2. The Ministry will no longer be able to provide Kedaireka services to Users;
  3. The Ministry will no longer be able to collect, use, and/or disclose Users' Personal Information, except for purposes subject to law and regulations or other legal purposes.
  1. STORAGE AND DELETION OF INFORMATION

All Personal Information provided by Users to the Ministry is stored on secure servers. By submitting Users' Personal Information on the Kedaireka Platform, Users consent to the transfer, storage, and processing that occurs on the Kedaireka Platform. The Ministry will take reasonable steps necessary to ensure that such Personal Information is treated securely and in accordance with the Privacy Policy and the applicable Terms and Conditions.

Please note that transmitting information over the internet is not entirely secure. Nevertheless, the Ministry will do its best to protect such Personal Information. The Ministry cannot guarantee the security of information transmitted to Kedaireka; the risk of any transmission is the responsibility of Users. Once the Ministry receives Users' Personal Information, the Ministry will use strict procedures and security features to prevent unauthorized access.

The Ministry will retain the information for as long as the User Account is registered as an active student in PDDIKTI and as long as the Partner account remains active, and may delete Users' information following the applicable legal provisions.

  1. SECURITY OF PERSONAL INFORMATION

Users' Personal Information will be stored and used by the Ministry, and its confidentiality will be guaranteed. The Ministry will not sell, disclose, or provide Users' Personal Information to any third party outside the Ministry except:

  1. If the Ministry has Users' consent;
  2. If the Ministry believes that access, contribution, storage, or disclosure of Personal Information is necessary to comply with applicable laws and regulations, legal processes, or legitimate government requests, enforce related Terms and and Conditions (including investigating potential violations of these Terms and Conditions or this Privacy Policy), to detect, prevent, or address illegal activities, fraud, security, or technical issues, or to protect the rights of the Ministry, other Users, or the public as required or permitted by law; or
  3. To third parties outside the Ministry who have a legitimate interest in knowing the User's Personal Information for the purpose of operating and/or improving services within the Kedaireka Platform, who have signed a confidentiality agreement with the Ministry, and are therefore bound by similar confidentiality obligations as stated in this Privacy Policy.

To ensure the security of the User's Personal Information, the Ministry has taken several technical and organizational security measures. For example, the Ministry maintains maximum technical security levels in all systems (including traceability, disaster recovery, access restrictions, etc.).

Additionally, the Ministry has implemented policies to ensure that Ministry employees (who are subject to confidentiality obligations) do not use Personal Information unless necessary in accordance with this Privacy Policy. These policies govern the Ministry when contracting with suppliers or introducing new Information Technology teams within Kedaireka.

The Ministry will use the User's Personal Information with the same level of care, but in no event less than the reasonable level of care used in its own comparable affairs, to maintain the confidentiality of all Personal Information.

The obligation to maintain the confidentiality of Personal Information will not or no longer apply to Personal Information that:

  1. Was already public knowledge at the time it was disclosed or became public knowledge thereafter by means other than through the Ministry's actions or omissions;
  2. Was already known by the Ministry before the Personal Information was disclosed;
  3. Was lawfully obtained by the Ministry from third parties without any obligation to maintain the confidentiality of such Personal Information;
  4. Was or is being independently developed by the Ministry from the Personal Information disclosed by the User;
  5. Has been authorized for disclosure by the User; and
  6. Must be disclosed under applicable laws, court orders, or other authoritative government institutions in any country with jurisdiction.

The User agrees that the Ministry will not be responsible for any security breaches related to messages, information, or documents sent by the User over the internet.

In the event of a failure to protect Personal Information within the Kedaireka Platform, the Ministry will notify the User in writing, either electronically or directly by registered mail.

  1. COOKIES

To provide the best service to the User, this website will place and access the Ministry's cookies on the User's computer. Cookies are small files that automatically take place in the User's device, functioning to store User preferences during a website visit. Although the User's device will automatically accept cookies, the User may choose to refuse cookies by setting privacy levels in the browser functions they use, noting that this may cause some features of the Kedaireka website to become unusable.

If the User has any questions regarding the Privacy Policy, suggestions, or complaints related to the Privacy Policy, the use and/or processing of the User's Personal Information, the User can visit the Kedaireka Frequently Asked Questions (FAQ) page.

  1. GOVERNING LAW

This agreement is governed by and interpreted in accordance with the laws of the Republic of Indonesia, without regard to conflict of law rules. The User agrees that any legal actions or disputes that may arise from or in connection with this site and/or this Agreement will be exclusively resolved within the jurisdiction of the courts of the Republic of Indonesia. All correspondence and contact within the Kedaireka Platform must be made or conducted in Indonesian.

  1. PRIVACY POLICY UPDATES

The Ministry may update this Privacy Policy to ensure that the Privacy Policy remains consistent with the development of the Ministry, the Higher Education Community, the Business and Industry World, and related parties and/or any changes in legal and regulatory requirements. The User agrees to be bound by the Terms and Conditions and the Privacy Policy in effect, which may be updated from time to time. Updates may be made at any time, either with or without notice via email. Users are encouraged to regularly check this Privacy Policy to be aware of any updates.

  1. ACKNOWLEDGMENT AND CONSENT

By agreeing to the Privacy Policy, the User acknowledges that they have read and understood this Privacy Policy and agree to all its terms. In particular, the User agrees and consents to the Ministry collecting, using, sharing, disclosing, storing, transferring, or processing the User's information in accordance with this Privacy Policy.

If the User provides Personal Information related to other individuals (e.g., Personal Information related to a spouse, family member, friend, or other parties) to the Ministry, the User represents and warrants that they have obtained consent from such individuals for, and hereby agree on behalf of those individuals to, the collection, contribution, disclosure, and processing of their Personal Information to the Ministry.
